General Terms and Conditions (GTC)

§1 Formation of the Contract and Exclusion of Claims
The contract is concluded as soon as an appointment is made with Nina Jares (hereinafter referred to as "Counsellor") for sex counselling or therapy, systemic counselling or therapy, or couples counselling or therapy, and thus the intention is pursued to receive individual, family, or couples counselling or therapy. The counseling or therapy with Nina Jares is not a medical treatment and is not a substitute for psychotherapy and/or pharmacotherapy. No anamnesis or diagnosis, nor the treatment of illnesses, takes place. Accordingly, no promise is made to heal or alleviate illnesses. The term "therapy" refers to a deeper counselling process.

§ 2 Counselling Success
The Counsellor cannot guarantee that all expectations directed at the counselling will be fulfilled. All parties, the Counsellor, and especially the client, work to the best of their knowledge and belief, using the resources available to them, to achieve the desired counselling success.

§ 3 Duration of Counselling and Termination
The duration of the counseling is determined by the needs of the client. No specific number of sessions is set. The counselling contract may be terminated at any time without giving reasons at the end of a counselling session, or with a notice period of 48 hours before the next appointment, informally in writing (including via email).

§ 4 Confidentiality
The Counselor is obliged to maintain confidentiality towards third parties. A release from confidentiality may only be granted with the client's written consent. The confidentiality obligation does not extend to the prevention or prosecution of suspected criminal acts or the protection of higher legal interests, and it does not include the right to refuse testimony, which applies in psychotherapy or medical treatment. If the Counsellor believes that the client or third parties are in danger of harm, she is entitled to inform the appropriate authorities.

§ 5 Health Condition
The client assures that they are not suffering from any condition that impairs their legal capacity or medically or psychologically excludes counseling or therapy. If the client is currently undergoing psychotherapy or has been advised to do so, the client agrees to inform both the Counsellor and the treating professional and to discuss the benefits and risks with them.

§ 6 Exclusion from Counselling
If the Counselor forms the impression during the session that the client exhibits psychiatric symptoms or confusion, the counseling session may be terminated with a request for the client to seek appropriate treatment. Clients who are acutely intoxicated or under the influence of alcohol and/or whose questions are based on criminal offenses will be refused by the Counselor. The counselling will also be immediately terminated if clients repeatedly make discriminatory statements of a religious, sexist, racist, or violent nature.

§ 7 Counselling Fee
An individual session lasts a full hour (60 minutes) and costs €130 including 19% VAT.. A couples session lasts 1.5 hours (90 minutes) and costs €250 including 19% VAT. This fee applies to the first session as well. The invoice will be sent to the client by email and must be paid within 7 days of receipt by bank transfer. These services are private services and will not be reimbursed by health insurance. If the Counsellor or the client determines within the first 30 minutes of the initial session that further collaboration is not productive, the session will be terminated by the respective party. In this case, no counselling fee will be charged to the client.

§ 8 Appointment Scheduling and Cancellation Fee
Appointments are agreed upon in advance between the contracting parties. A cancellation free of charge is possible via email up to 48 hours in advance (for Monday appointments by Friday at 12:00 noon). Short-term cancellations by the client less than 48 hours in advance (for Monday appointments by Friday at 12:00 noon) or failure to appear for a scheduled appointment will be charged. The cancellation fee amounts to 50% of the regular fee for the missed session.

§ 9 Jurisdiction, Liability, Self-Responsibility
The place of jurisdiction is Düsseldorf. The Counsellor is liable to the client only for damages caused intentionally or by gross negligence. Liability is limited to the amount of the counseling fee paid. The client acknowledges that they are fully responsible for their physical and mental health throughout the counseling process, both during the individual counseling session and in the time between sessions. The client acknowledges that all steps and actions undertaken in the course of the counseling sessions are within their own responsibility. The client agrees to inform the Counsellor about any actions with far-reaching consequences and to discuss these with the Counsellor in advance.

§ 10 Supervision
The Counsellor regularly participates in case supervision (group or individual). The goal of supervision is to reflect on and support the counseling and therapeutic work to improve performance. The Counsellor discusses the content of counselling or therapy sessions anonymously in this context.
